Terms and conditions

Purpose

These terms govern the use of the MyCarPortal platform, operated by MyCarPortal, Darko Spasenov. MyCarPortal connects drivers with car professionals and allows vehicle listings to be published. By creating an account, you accept these terms.

Account

Creating an account is free. You undertake to provide accurate information, to keep your password confidential and to report any unauthorised use of your account to us. An account can manage only one business.

Free services

Searching for professionals, browsing listings, quote requests and messaging with professionals are free for private users.

PRO subscription

The PRO subscription makes a business page visible on the platform. It costs CHF 60 per month or CHF 600 per year. Payment is made by bank card when the subscription starts, and the subscription then renews automatically at each renewal date. The monthly plan can be cancelled at any time for the end of the current period. The yearly plan can be cancelled at the latest 30 days before the renewal date; after that, cancellation takes effect at the end of the following period. If payment remains outstanding, the business page and vehicles are taken offline until the payment is settled. During a launch period announced on the site, the card is registered when subscribing and the first payment is taken the day after the last free day.

Vehicle listings

A private user publishes a listing for CHF 19.95: it stays online for 1 month. They can then extend it for CHF 9.95 per month. Nothing is renewed or charged automatically: a reminder is sent by e-mail 3 days before the end, and a listing that is not extended is hidden, without being deleted. The PRO subscription includes 5 vehicles online at the same time; 5 additional vehicles cost CHF 40 per month or CHF 400 per year, and 10 additional vehicles CHF 60 per month or CHF 600 per year, depending on the subscription. A sold or deactivated vehicle frees its slot. If a business has more vehicles online than its subscription includes, the oldest listings are deactivated, without being deleted. During a launch period announced on the site, putting a page online and publishing listings may be free; the end date is displayed, and prices apply afterwards. After publication, the make, model, version, year, mileage, fuel, gearbox, power and main photo can no longer be changed. A verified phone number is required before any publication.

Payment

Payments are processed by our provider Stripe: by bank card for subscriptions, by bank card or TWINT for listings. MyCarPortal does not keep any card data. Prices are in Swiss francs. Unless the law provides otherwise, amounts paid for a published listing or for a current subscription are not refunded.

Your commitments

You undertake to publish accurate and up-to-date information, to offer only vehicles or services that you are entitled to offer, to comply with the law and the rights of third parties, and not to use the platform for unsolicited advertising. Misleading, unlawful or offensive content is prohibited.

Role of MyCarPortal

MyCarPortal is a technical intermediary. Quotes, services and sales are concluded directly between users; MyCarPortal is not a party to any of these contracts and guarantees neither the accuracy of listings nor the quality of services. Within the limits permitted by law, the liability of MyCarPortal, Darko Spasenov is limited to direct damage caused intentionally or through gross negligence.

Suspension and deletion

We may remove content or suspend an account that breaches these terms, following a report or on our own initiative. You can delete your account at any time from your account area, once your subscription has been cancelled. A business can also deactivate its page from “My page” (it is then hidden, not deleted, and the subscription continues) or delete it; deletion stops the subscription immediately, with no refund for the current period.

Changes to the terms

We may adapt these terms. Registered users are informed by email of significant changes at least 30 days before they come into force.

Applicable law and jurisdiction

Swiss law applies. The place of jurisdiction is Fribourg, subject to the mandatory places of jurisdiction provided by law, in particular in favour of consumers.
